General and Specific Conditions of Sale
seasonal rental
Article 1 – This transaction concerns the rental of one or more gîtes (Le Colombage and/or Le Schopf) at REPAIRE DES HIRONDELLES, 43 rue principale, 67310 Scharrachbergheim. It is reserved for the exclusive use of furnished tourist accommodation.
Article 2 - Length of stay : The client reserves accommodation at Repaire des Hirondelles for a period determined at the time of booking, and may under no circumstances claim a right to remain on the premises after this period.
An extension of stay is possible upon prior request, subject to availability and current rates.
Article 3 – Reception capacity : Le Colombage cottage can accommodate up to 5 people, and Le Schopf up to 6 people. The number of occupants is set at the time of booking and determines the price of the stay. Any additional person will be charged at the current rate. If the maximum capacity is exceeded, the owner reserves the right to refuse access. Changes or cancellations are the responsibility of the guest.
Article 4 - Accessibility : Access to the lodgings is not designed for people with reduced mobility.
Article 5 - Animals: Pets are not allowed. If the tenant fails to comply with this clause, the owner reserves the right to refuse the stay without any refund.
Article 6 - Reservation formalities : After making a reservation on the website https://www.lerepairedeshirondelles.com, the customer will receive a confirmation email. The owner asks the customer to check the details of their reservation:
- Their contact details, in particular their email address and mobile phone number, so that they can be contacted before and during the booking.
- The accommodation booked, the number of people, the age of children if applicable, the arrival date, the departure date, and the number of nights.
- The total price, tourist taxes included.

Article 7 – Payment conditions:
For any reservation made within 7 days before the arrival date, the total amount of the stay must be paid by credit card at the time of booking. If you wish to use another payment method, we invite you to contact us by telephone at +33 (0) 786 42 41 03 or by email at the following address: contact@lerepairedeshirondelles.fr.
A 25% deposit is required for all bookings from D+7. 25%.
Payment can be made immediately by credit card or within 7 days by bank transfer. Failure to pay within this time period will result in the reservation being canceled. The balance must be paid 7 days before arrival. Information regarding the balance payment will be communicated by email a few days before the due date.
The reservation takes effect as soon as the owner receives a 25% deposit or full payment, depending on the terms chosen. Payment of the deposit or balance constitutes acceptance of the general conditions.
The rental established between the parties to this contract cannot be transferred, even partially, to third parties, whether natural or legal persons, without the written consent of the owner.
Access to the reservation is strictly reserved for persons aged 18 and over.
Article 8 - Invoice: An invoice detailing the service, accommodation, additional services, and tourist taxes is given to the customer upon request, at the end of the stay.
Article 9 – Arrival time : The tenant can arrive on the scheduled day from 3:00 p.m. Upon prior request, at the earliest the day before arrival and subject to the availability of the accommodation(s), the arrival time can be brought forward.
The tenant will inform the owner of his arrival time at the latest the day before.
In the event of late or delayed arrival, the tenant is required to inform the owner in a timely manner.
Article 10 – Departure time : Gîtes must be vacated by 11:00 a.m. at the latest on the day of departure. Late check-out may be granted on the same day, subject to prior request and gîte availability.
Article 11 - Use of the premises : To ensure the comfort of all residents, the tenant is required to ensure the tranquility of the premises and to use them in accordance with their intended purpose. Parties, as well as smoking or vaping, are prohibited. For safety reasons, the use of open flame lighting devices is prohibited.

Article 12 - Electrical recharges:
Le Repaire des Hirondelles does not have facilities for charging electric vehicles. It is not permitted to connect a vehicle to the gîtes' domestic network. Charging bicycle batteries is permitted, provided it is carried out under supervision. Electric batteries or other electronic devices belonging to the tenant are their responsibility. The latter will be held financially responsible for any fires or damage caused by these items.
Article 13 - Damage insurance : The tenant is responsible for any damage they cause and must be insured. Any damage must be reported to the landlord.
Article 14 – Final cleaning: Cleaning of premises in normal use is the responsibility of the owner. In the event of abnormal use of the premises or exceptional soiling, the cleaning costs (€60 for Colombage and/or €80 for Le Schopf) will be re-invoiced to the tenant.
Article 15 – Payment of charges : Water, electricity, and heating costs are included in the rent, based on normal consumption. In the event of abnormal consumption, additional costs may be charged to the tenant.
Article 16 – Modification / cancellation by the tenant: Any cancellation/modification must be notified to the owner.
The tenant has the option to cancel their stay free of charge up to 14 days before arrival. In this case, the client will be fully refunded any amounts paid.
Requests for changes to the dates of stay or the number of participants can be made by telephone or by email at contact@lerepairedeshirondelles.frChanges to dates and duration are possible up to 7 days before the start of the stay, subject to availability. The rate will then be adjusted according to the new parameters and the prices applicable to the modified dates.
In the event of cancellation less than 14 calendar days before the arrival date, any deposit paid will be retained by the owner. The owner is also entitled to request the remaining balance of the stay. However, if the owner manages to re-let the gîte(s) for the entire period in question, the tenant will be reimbursed.
In the event of early departure, the full rental amount remains due to the owner. No refunds will be issued.
Article 17 - Non-Show: No-show will result in full payment of the reservation.
Article 18 - Cancellation insurance: The owner informs the client that no cancellation insurance is included in the proposed rates. Therefore, it is strongly recommended to take out such insurance with an external insurer.
Article 19 - Cancellation by the owner : If the owner must cancel the reservation before the start of the stay, he will inform the customer by email or telephone as soon as possible. The customer will then be fully refunded for the amounts paid.
Article 20 - Disputes : Any dispute relating to the rental will be submitted to the competent local judicial authority.
Article 21 - Data Protection Act: Pursuant to Article 27 of the French Data Protection Act of 6 January 1978, you have the right to access, correct, and oppose any information concerning you. We guarantee the protection of your personal data.
We only collect your personal data through our website if you expressly provide it, for example if you make a reservation request or request information.
The data you provide to us through this means will be used exclusively for the stated purpose, i.e. to process your request and to send you the requested information.
We comply with the General Data Protection Regulation (GDPR).
The information collected on the contact form is recorded in an email in order to respond to your request.
They are not stored in a database.
The information collected on the reservation form is stored in our management software in order to manage your reservation:
They are intended for the management of your account (establishment of the rental contract, invoicing)
They are kept:
for 10 years to comply with the legal obligations of NF525 (obligation to archive invoicing data for the purpose of tax administration control).
The email address may be used to send information about Le Repaire des Hirondelles, or the status of your account.
Your phone number may be used to follow up on your reservation, or in response to your request.
It will under no circumstances be shared with third parties or used for telephone canvassing. Because we store your telephone number, we are, however, required to inform you of the existence of the "Bloctel" telephone canvassing opt-out list, on which you can register here:https://conso.bloctel.fr/.
